The owners of thirty one homes in Menifee, CA file construction defect lawsuit against K. HOVNANIAN COMMUNITIES, INC.

MENIFEE, CA A construction defect lawsuit has been filed in the Riverside County Superior Court against homebuilder K. Hovnanian Communities, Inc. on behalf of the owners of 31 homes in the neighborhood of Hidden Meadows located in the City of Menifee. The lawsuit alleges the existence of multiple defects in the homes. The lawsuit was filed on behalf of the plaintiff homeowners by the law firm of Kasdan Simonds Weber & Vaughan LLP.


These homes were not built in accordance with approved Building Standards, said Ken Kasdan, the senior partner of the Kasdan Simonds firm. Along with the homeowners loss of comfort and enjoyment, these relatively new homes appear to be of such poor quality that the owners find it necessary to initiate legal action.

According to the lawsuit, construction defect problems include:

Windows and patio doors, and their respective systems, allow water to enter the structure.

The roof, and roofing system allow water to enter the structure.

The foundation system and concrete slab allow water and/or vapor to enter into the structure.

The Stucco, exterior walls, and other exterior finishes and fixtures and the systems of those components are installed so as to allow water to pass into the structures.

Shower and bath enclosures leak water into interior of walls and into flooring systems.

Ceramic tile and tile countertops allow water into interior of walls and other components.


Other alleged defects include:

Foundations, load bearing components and slabs contain significant cracks and/or significant vertical displacement;

Foundations and slabs are constructed so as to allow chemical deterioration and/or corrosion;

Excessive cracking of stucco and exterior wall finishes;

Irrigation systems and drainage do not operate properly causing damage to landscaping and other external improvements.

As a direct result of the Defendants violation of the Building Standards, and the defects and deficiencies, Plaintiffs have been damaged and request damages believed to be in an amount in excess of $3 million dollars.
