CARSON, CA -- A construction defect lawsuit has been filed in Los Angeles County Superior Court against homebuilder K. Hovnanian on behalf of 84 homeowners in the City of Carson. The homeowners claim their homes in the Dominguez Hills Village community suffer construction defects including inadequately designed and installed plumbing systems. The lawsuit was filed on behalf of the homeowners by the Irvine law firm of Kasdan Simonds Weber & Vaughan LLP.
Plaintiffs allege that defects and deficiencies exist in the development, workmanship, repairs, materials, planning, design, engineering and construction of their homes. The construction of the plumbing systems in the homes is inadequate, not in accordance with approved plans/specifications, in violation of the Uniform Building Code, and below accepted standards for the construction industry, according to the lawsuit.
The construction defect problems include leaking copper pipes, according to the lawsuit.
Ken Kasdan, the firm's senior partner, says, "The plumbing systems in these homes began to fail after only a few years, which makes the quantity and severity of the alleged defects quite disturbing for these homeowners."
The homeowners believe:
• The Defendants knew that the defects and definciencies in the homes would cause them to be unfit and unsafe for the purpose for which it was intended;
• The Defendants acted in conscious disregard of the safety of the public;
• The Defendants placed the homes on the market without warning consumers of the defects and deficiencies;
• In placing a product known to be unsafe and unsuitable for its intended use in the market, and in deliberately neglecting, in order to make a profit, to caution customers and the unknowing public, Defendants exhibited, and continue to exhibit, a conscious disregard of the probability the Defendants' actions would result in injury to others.
The lawsuit claims that the cost to correct, replace and reconstruct the defects affecting the 84 homes and property is believed to be in excess of two million dollars (2,000,000.00).
